Hi. This question just happens to be right up my alley as I was a legal secretary for 23 years. What your nephew needs is a very good criminal attorney to appeal the decision based on an evaluation from a professional psychiatrist who will testify to the fact that he is mentally ill and needs to be in a hospital rather than a prison. He will need an evaluation which the attorney could set up for him. A good attorney will already know of a good psychiatrist to do this sort of an evaluation and who also has experience testifying in court. You should look into good criminal attorneys in your area who have very high reputations. If you need a referral for one, every state generally has a State Bar referral service that you could call to get a referral. It would be best that you interview more than one and really check into how good the attorney is and what kind of record he has for winning his cases. I say this because I know from experience that when dealing with the court system, the reality of the matter is: "the best attorney wins" most of the time regardless of what the case is and this is because they know the law so well. So you will need someone sharp, very good at his job and genuinely interested in helping your nephew. The more knowledgable he or she is and the more experience they have, the better it will be for your nephew. Also, if you see or get the feeling that the attorney is really interested in the case, that helps also as they will work harder to get the result they want which in turn, will benefit your nephew. So what I'm basically telling you here, is that the attorney you choose will be very important in a case like this because, as I said, the better attorney you have for your nephew, the better his chances are of being put into a state hospital for the help he needs.
